The client was a new resident in the UK, coming over with her family to work in health care.</p>
<p>The caution had been the result of a minor argument that became heated. The police were called and the client was taken away by the police to prevent any further incidents that evening. The client&#8217;s husband begged for the police not to arrest his wife, the police however still arrested the client due to their pro-active action policy in cases of domestic assault.</p>
<p>The client who was totally unfamiliar with legal proceedings, was completely shocked to be arrested and detained in a police cell. She was terrified of what the police might do, and how it might effect her work and immigration status. When the police offered her a police caution, she jumped at the chance, not understanding its full implications, simply wanting to leave the police station as fast as possible.</p>
</div><div class="fusion-title title fusion-title-1 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Police Caution Deletion</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-2"><p>Once she left the police station, and after having time to reflect on her situation, she researched the implications of the caution and was shocked to realise that it would be disclosed on DBS background checks, and would <a href="https://www.gov.uk/government/publications/good-character-nationality-policy-guidance" target="_blank" rel="nofollow noopener noreferrer">prevent her application for UK citizenship</a> for at least three years.</p>
<p>The client and her husband got in touch with us to  have her caution removed.</p>
<p>We promptly prepared detailed legal representations which persuaded the police to delete the client&#8217;s police caution from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a>.</p>
<p>Now that the client&#8217;s caution has been deleted, she has been able to process her application for citizenship and also has a clean <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">DBS certificate</a>.</p>

<p>Our client had been involved in a domestic dispute with his siblings, which resulted in the police being called. The allegation was minor, but the police decided to arrest our client on the basis of avoiding an ongoing incident.</p>
<p>The client had never been arrested before, and so was very unsure of what to do. The client was afraid to ask for a duty solicitor, believing this would make matters worse, and make him look guilty. The police had also told him that asking for the duty solicitor would mean he would have to spend more time in the police station.</p>
<p>The client decided to accept a police caution, and left the police station believing that his record would be wiped after 5 years.</p>
</div><div class="fusion-title title fusion-title-3 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Removal of Police Records</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-5"><p>The client was a student at the time and wanted to move into roles where national security vetting would be required. On undertaking online research he learned that the caution would not in fact be deleted after 5 years, but that it would be retained until he reached 100 years of age. He also came to realise that the police would also keep documentary records of what happened, such as his record of interview, witness statements and his custody record. Along with these records his <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">DNA, fingerprints</a> and custody photograph would also be retained.</p>
<p>Once the client realised the long term impact of his arrest and police caution, he got in touch with us.</p>
<p>We analysed the evidence in his case, and advised him he had a case to argue for his caution to be deleted.</p>
<p>We promptly set out our findings to the police, who agreed to delete the clients caution from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a>, his <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">biometrics</a> and his custody record. Subsequently we applied for the deletion of his <a href="https://policecautions.uk/2019/01/28/what-is-the-police-national-database-pnd/">PND records</a>, which the police agreed to delete in their entirety.</p>

<p>The police had agreed to not only expunge the caution, but also to expunge the entire Police National Computer (PNC) record. This means that when a PNC check is undertaken by the police, the client will return a “no trace” record. This will therefore mean that a standard DBS check will be clear, and also it is very unlikely any information will be disclosed on an enhanced DBS check.</p>
<p>Had the caution remained on the PNC (as the type of offence the client had been issued the caution for is on a proscribed list of offences) it would have been permanently disclosed on both a standard and enhanced DBS check – this would have effectively destroyed the client’s career. It also would have made it very difficult for the client to obtain visas for countries such as the US, Australia or certain Middle Eastern countries.</p>
</div><div class="fusion-title title fusion-title-7 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">The Law Enforcement Data Service</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-11"><p>The government is currently <a href="https://www.gov.uk/government/publications/law-enforcement-data-service-privacy-impact-assessment" target="_blank" rel="noopener">consulting on the introduction of a new super-database for the police</a>. This will combine two existent databases, the PNC and the PND and other systems, into one unified dataset for the police to use:</p>

It will replace the existing Police National Database (PND) and the Police National Computer (PNC) with the new LEDS. The new platform will potentially allow addition of new data sets at a later date.

PNC was first used in 1974 and continues to run on broadly the same technology as it did at that time. PNC allows the sharing of records of interactions with the police, law enforcement agencies and the criminal justice system. PND is more modern, having been introduced as a recommendation following the Bichard enquiry into the Soham Murders. <p>It is possible, with the police casting a wider and more effective net when it comes to data collection and retention, that more information, and at a greater frequency, will be disclosed on enhanced DBS checks.</p>

The police retain a broad discretion as to when and what they can disclose on an enhanced DBS check, and this information does not have to related to actual convictions or cautions, but can be simple allegations that were never proven, or even allegations that you didn’t know about.</p>

<p>After we reviewed the evidence, we noticed there were some serious defects in the way in which the case had been handled by the police. We submitted our findings to the police, who agreed the caution was defective, and deleted the client’s caution, PNC record and biometric data.</p>

The caution will be disclosed on a <a href="https://www.policecautions.uk/standard-disclosure-and-barring-service-dbs-certificates/">standard</a> and <a href="https://www.policecautions.uk/enhanced-disclosure-and-barring-service-certificate-dbs/">enhanced DBS</a> certificate for 6 years, and may continue to be disclosed on an enhanced certificate after 6 years.</p>
<p>If you work in a regulated profession such as health care, teaching, finance or the law, then a police caution will usually need to be disclosed to your regulator and will be show up on a DBS check.</p>
<p>If your caution is however expunged (deleted) then you will no longer have a police caution, and it will no longer show up on a DSB check.</p>
