Once deleted you will be “no trace” on the PNC, which will have positive implications for both a DBS certificate, and an ACRO Police Certificate.</p>

<p>If your caution is removed from the PNC, then there probably will also be <a href="https://policecautions.uk/2019/01/28/what-is-the-police-national-database-pnd/">locally held police records</a>. Most often these records do not cause issues, but can sometimes cause issues on <a href="https://policecautions.uk/2019/11/03/can-you-appeal-a-dbs-check/">enhanced DBS checks</a>, depending on the case. <p>If the police are considering whether to issue a police caution, you can at that point challenge the case against you. You may be able to persuade the police that the evidence against you is weak, or that there is no public interest in issuing a caution.</p>
<p>A solicitor should be able to assist you in challenging the imposition of a police caution.</p>
<p>If the police are unwilling to drop your case altogether, they maybe willing to adopt an alternative outcome in your case, such as a <a href="https://policecautions.uk/2018/02/03/community-resolution-successfully-deleted-for-client/">community resolution</a> or a penalty notice. A community resolution or <a href="https://policecautions.uk/2018/06/25/penalty-notice-for-disorder-pnd-for-shoplifting-deleted/">penalty notice</a> would not have the same impact on your criminal record as a police caution.</p>

<p>If the caution has been issued very recently, namely within the last day or so, you may be able to go back to the investigating officers, and directly challenge the caution.</p>
<p>This option is not very likely to succeed, as often the police will have already moved onto their next case, and will not want to revisit your case. This approach also risks the possibility that the police may remove your caution, but then charge you and prosecute you at court.</p>

<p>You can set out the legal arguments why you believe your caution should be removed. <a href="https://www.acro.police.uk/" target="_blank" rel="noopener">ACRO</a> will pass your application onto the police force concerned, who will then take a decision.</p>
<p>There are a number of different grounds that you can set out to challenge a police caution. For example, you may be able to argue that the allegation was false or malicious, that no crime had been committed, or that there is no public interest in keeping your caution on the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">Police National Computer (PNC)</a>.</p>
<p>Alternatively, you could lodge a complaint with the police, but this will depend on the circumstances of your case.</p>
<p>If the police refuse to delete your caution, you can then consider taking your case to Court, to have a judge decide your case.</p>

This approach is high risk, as you will incur steeper costs. Even if you do not instruct a solicitor you will need to pay court fees, and if you lose, you will risk having to pay the police’s legal costs.</p>
<p>If you challenge your caution by applying to ACRO first and they refuse, you may then be able to appeal your case to the <a href="https://www.gov.uk/courts-tribunals/administrative-court" target="_blank" rel="noopener">Administrative Court</a>. This however will depend on the facts of your case, and the timeframe. You will need to carefully bear in mind the time since your caution was issued, and when the police took their decision to refuse to remove your caution. The Court can be unforgiving if you miss a relevant deadline.</p>
<p>If you do challenge your caution via ACRO, when preparing your deletion application you will need to frame your application bearing in mind the law and criminal procedure. You will need to keep in mind how a High Court judge might perceive your case, even if you have no intention of actually issuing Court proceedings. By bearing in mind previous case law your application will have a greater chance of success, and will come over as credible and reasonable to the police.</p>

The client had been issued a caution for racially aggravated assaulted after a night out.</p>
<p>The client had been drunk at the time and had been accused of assault after his friends had been thrown out of a nightclub. The client was accused of assaulting a doorman in the process of defending his friends, and had also been accused of using racially abusive words.</p>
<p>The client did not accept, despite his intoxication, that he had not acted reasonably, and he did not admit to using the racially abusive words. The police however pressed the client into accepting a police caution, variously telling him that matters would be made worse if he did not admit the allegation, and that the caution would have no serious long term implications.</p>
<p>The client agreed to accept a police caution and hoped to put the incident behind him.</p>
</div><div class="fusion-title title fusion-title-14 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Police Caution Deletion</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-17"><p>It was only a some time later when he was looking to emigrate for work purposes that the caution became an issue; the caution was indirectly disclosed on his <a href="https://policecautions.uk/2019/03/24/what-is-a-police-certificate/">ACRO police certificate</a>. Due to the nature of the allegation, the caution would cause serious difficulties in obtaining a work Visa, also as his employers would be processing his Visa, they would come to know about the caution.</p>
<p>After we were instructed we promptly reviewed all the evidence in the case. We noticed some anomalies in the witness statements, and gaps in the evidence that had not been explored by the police.</p>
<p>Within a relatively short period of time the police agreed with our representations and deleted the client&#8217;s caution, the entire <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC record</a> and <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">biometric data</a>.</p>
<p>Now that the caution is deleted the client&#8217;s ACRO police certificate will state &#8220;no trace&#8221; as opposed to &#8220;no live trace&#8221; .</p>

<p>Our client was accused of assaulting her house mates. The client had been interviewed at the police station, and had accepted the services of the duty solicitor. After the interview, on the advice of the lawyer, she accepted a police caution for assault.</p>
<p>After learning about the full <a href="https://policecautions.uk/police-caution-procedure/">consequences of the caution</a>, the client contacted us to have her police caution deleted.</p>
<p>The client had been suffering from a serious mental illnesses at the time of the caution. We therefore argued that our client had been <a href="https://en.wikipedia.org/wiki/Insanity_in_English_law" target="_blank" rel="noopener noreferrer">legally insane according to the &#8220;M&#8217;Naghten Rules&#8221;.</a></p>

<p>The client, after spending the night in a police cell, worrying about work the next day, readily accepted the police’s version of events and accepted a police caution.</p>
<p>The police told the client the caution was of limited consequence and if he didn’t agree to it he would be prosecuted.</p>
<p>After leaving police custody, the client investigated the true implications of the caution, and the correct procedures the police ought to have adopted at the police station. The client then contacted us.</p>
<p>After accessed his case, we were able to identify errors in the caution procedure adopted by the police and the client’s arrest.</p>
<p>We promptly made representations to the police who ultimately agreed to not only delete the client’s police caution, but also agreed to expunge the clients arrest record, DNA, finger prints and custody photograph.</p>

<h2>Arrest Record Deletion</h2>
<p>When a suspect is arrested, the police will create a <a href="https://policecautions.uk/deleting-of-arrest-records-from-the-police-national-computer-pnc/">Police National Computer (PNC) arrest record</a>.</p>
<p>An arrest record will be retained indefinitely (until the person is 100 years old) unless the police agree to delete it. An arrest record will therefore be created even if a suspect is never cautioned nor convicted.</p>
<p>An <a href="https://policecautions.uk/deleting-of-arrest-records-from-the-police-national-computer-pnc/">arrest record</a> can cause an individual difficulties as it can be disclosed on enhanced Disclosure and Barring Service (DBS) certificates.</p>
<h2>Police Caution and Arrest Record Deletion</h2>

<h2>Disclosure and Barring Service Appeals</h2>
<p>Along with successfully applying for the expungement of police records, we also are often instructed to challenging DBS certificates and DBS applications to bar.</p>

<p>If you have already been placed on the barred list, we can apply to have you removed. <p>The client worked in care and the caution, which was for assault, would have prevented her from continuing to work. Clearing the caution and arrest record will mean that a police certificate, required for immigration purposes, will also be cleared. The client’s police certificate will now state “no trace” rather than “no live trace”.</p>
<p>The caution was issued many years ago, but despite this, we were able to identify errors in the handling of the case which meant the caution was defective. The police agreed within a very short period of time to delete the record.</p>
<h2>Police Caution Deletion</h2>

<h2>Police Caution Removal Solicitors</h2>

<h2>Arrest Record Deletion</h2>
<p>Even if you have simply been arrested, namely you were arrested and detained, but the police took No further Action (NFA) against you, your details will appear on the PNC.</p>
<p>An arrest record can appear on an Enhanced Disclosure and Barring Service (DBS) certificate and can affect immigration applications.</p>
<h2>Disclosure and Barring Service (DBS) Children and Vulnerable Adults Barring</h2>
<p>A simple arrest, where no further action was taken, can sometimes precipitate an investigation and enquiry by the DBS into whether someone should be barred from working with children and vulnerable adults. If you have been arrested, and you then subsequently apply for an enhanced DBS certificate, information may be passed to the DBS, which could trigger a barring investigation.</p>
<p>If you have been cautioned or convicted of certain relevant crimes, then the DBS will undertake a barring investigation under their automatic barring procedure. Some automatic inclusion offences however permit an individual to make representations before they are barred.</p>
<p>We have had significant success in appealing auto-barring applications and applications where relevant information has been passed to the DBS.</p>
<p>We have also successfully had clients removed from the barred list where mistakes were made in the original barring decision, or where it was no longer appropriate to keep someone on the barred list after the minimum barring period has elapsed.</p>

<h2>Admission to a Police Caution</h2>
<p>If a suspect does not admit the allegation then a police caution cannot be issued. An admission to an allegation needs to be clear and reliable and freely given. What amounts to a freely given and clear and reliable admission is often open to interpretation. In a common assault allegation for example, it may be open to dispute as to whether someone has raised self-defence, or in theft allegation, whether dishonesty or an intention to permanently deprive has been admitted.</p>
<h2>Reliable Consent to a Police Caution</h2>
<p>Along with providing an admission. Consent to a police caution must be freely and reliably given, namely a suspect must understand the full implications of a police caution before they accept it. For example they must understand the impact a police caution will have on immigration, on employment, on fostering, on working with children or vulnerable people. A police caution will have a significant impact on all of these aspects of someone’s life, and so it is important that the police explain all the implications of a police caution in clear terms.</p>
<p>The police also ought to offer a suspect the possibility of receiving competent legal advice before they accept a police caution. Most often this will mean receiving advice from a duty solicitor. Sometimes, the police may tell a suspect that, because a police caution is minor (in their view) that there is no need for a solicitor, or will perhaps tell a suspect that waiting for a solicitor will mean they will have to wait in a police cell for a long time. Sometimes people simply fear that asking for a solicitor may make matters worse, and the police will be more harsh on them. If the police have unfairly deprived a suspect of their right to legal advice, it can form a basis to challenge the validity of a police caution.</p>
<p>Sometimes the police may hold out the offer of a police caution as an inducement to confess, this is strictly prohibited. An unfair inducement to confess could form the basis of a challenge to a police caution.</p>
<h2>Police Cautions</h2>
<p>Along with a simple police caution, there is also a conditional caution, a youth caution and a youth conditional caution.</p>
<p>A conditional caution requires certain conditions to be fulfilled by a suspect, such as writing a letter of apology or paying a fine, for the caution to be fulfilled. If the conditions are broken, then the police/CPS reserve the right to charge and prosecute a suspect.</p>
<h2>Police Cautions and Criminal Records</h2>
<p>A police caution forms part of someone’s “criminal record”, what a criminal record is however will depend on who is asking.</p>
<p>On a basic disclosure certificate a simple police caution will not show up, a conditional caution will show up for three months, or before, if the conditions are satisfied.</p>
<p>On a standard DBS certificate most police cautions will not show up after 6 years, on an enhanced DBS check a caution is likely also not to be disclosed, but may be disclosed if the police deem it relevant to a particular role.</p>
<p>A specified list caution however, namely a caution for an offence that is more serious (including offences such as ABH, sexual assault and child cruelty) will show up forever on both a standard and enhanced DBS certificate.</p>
<p><em><strong>NB, November 2020 edit: </strong></em><a href="https://policecautions.uk/2019/01/31/what-is-the-impact-of-the-2019-supreme-court-decision-on-disclosure-of-youth-cautions-warnings-and-reprimands-and-also-adult-cautions/">Youth cautions, warnings and reprimands are immediately  &#8220;protected&#8221;</a> subsequent to changes implemented by the government. This means that even for offences that appear on the DBS list of unfilterable offences, they will not be automatically be disclosed on an enhanced and standard DBS check. It should be noted however despite the changes, it is still possible for facts related to youth cautions, warnings or reprimands to still be disclosed on an enhanced DBS certificate if the police feel the information is &#8220;relevant&#8221;.</p>
