The background
Our client was training to work in the health sector. If the community resolution had come to the attention of the client’s regulator, the nature of the offence meant it might have prevented the client from qualifying.
What we did
We obtained the case papers from the police. They showed that the community resolution had been unlawfully issued, and we set this out in our application.
The outcome
The police agreed to expunge the community resolution from our client’s records.
Community resolutions and DBS checks
A community resolution is not a conviction or a caution, and it is not usually recorded on the Police National Computer. It is still kept on local police systems, and if you were arrested during the investigation there will also be an arrest record on the PNC.
For roles in healthcare, teaching and other trusted work, the police can disclose information they think is relevant on an enhanced DBS certificate, and that can include a community resolution.
