Our client had been issued with a youth final warning (called a youth caution today) for a sexual assault.
The facts of the allegation were complex, and related to bullying the client had been the victim of at school. The school had failed to protect him from ongoing bullying and which had culminated in a manufactured incident by his tormentors.
When the client was at the police station he did not have any legal advice, and was effectively railroaded into accepting the caution by the police. His family was misled about the applications of the caution, and agreed to its imposition.
Deletion of Sexual Assault Caution
We reviewed the evidence, spoke to witnesses, and we were able to piece together what had actually happened.
We presented our findings to the police, who promptly agreed to the compete deletion of the client’s PNC record and biometric data.
Now that the caution is deleted the client’s DBS check will be clear, also his ACRO Police Certificate will now state “no trace” as opposed to “no live trace”.
