<p>In order to be eligible to apply under the Visa Waiver Programme, you must possess a <a href="https://www.dhs.gov/visa-waiver-program-requirements" target="_blank" rel="noopener noreferrer">passport with specified security features</a>, it must have a digital photograph of yourself printed on the data page, and your passport must also have a machine-readable zone.</p>

<p>The countries that require a Police Certificate include, Australia, Belgium, Canada, Cayman Islands, New Zealand, South Africa and the USA.</p>
<p>For the USA, you will also require a Police Certificate not only if you intend to work or live in the US, but if you have ever been arrested (or cautioned or convicted) &#8211; the USA does not permit travel on an ESTA where someone has a criminal record, including arrest records. </div><div class="fusion-title title fusion-title-12 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">What will Show on a Police Certificate?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-15"><p>A Police Certificate will include details about all convictions, reprimands, warnings and cautions recorded by the police. A Police Certificate however will not disclose any &#8220;stepped down&#8221; records.</p>
<p>A record will be stepped down according to the type of offence, and number of years that have elapsed. For example, a caution for common assault will be stepped down after 5 years. <p>After a criminal record is stepped down, it will nevertheless still be indirectly revealed on a Police Certificate; after the step down period a Certificate will state &#8220;No Live Trace&#8221;. If someone has never had a criminal record, or had their record expunged, their Police Certificate will simpy state &#8220;No Trace&#8221;.</p>
<p>If a &#8220;No Live Trace&#8221; record is revealed, then a foreign nation, notably the USA, will request full details about that person&#8217;s previous record.</p>
<p>As with the USA, a criminal record can impact travel and work visas to other countries. For example, a police caution can also cause serious issues for <a href="https://policecautions.uk/2025/03/20/navigating-immigration-to-saudi-arabia-with-a-police-caution/">residency and work visas to Saudi Arabia</a> or <a href="https://policecautions.uk/2023/10/26/will-a-police-caution-affect-a-visa/">China</a>.</p>

<p>The client had lived for years worrying about the caution, and avoiding applying for regulated jobs for fear of the caution being disclosed.</p>
<p>We reviewed the evidence in her case and advised that she had a case to apply for the <a href="https://policecautions.uk/police-caution-procedure/">deletion of her police</a> caution from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a>.</p>
<p>Within a relatively short period of time the police agreed to delete the client&#8217;s caution form her record.</p>
<p>Now that the caution is deleted her police caution states &#8220;no trace&#8221; as opposed to &#8220;no live trace&#8221;.</p>

<p>After reviewing the case, we were able to identity a potential avenue of appeal. Within a relatively short period of time the police had agreed to overturn the caution.</p>

It is, generally speaking, an offence to be in possession of blade or point in public unless it is a <a href="https://www.cps.gov.uk/legal-guidance/offensive-weapons-knives-bladed-and-pointed-articles" target="_blank" rel="noopener noreferrer">folding pocket knife under three inches</a>.</p>
<p>The client, as he was student looking to work in a regulated profession, was extremely concerned about the impact the caution would have on him &#8211; it was very likely to prevent him entering his chosen field of work.</p>
<p>After exploring the evidence in the case we noticed that there had been a number of serious errors by the police, and that important evidential considerations had been overlooked.</p>
<p>The client had been going through some extensive and overwhelming mental health issues at the time, and we spent a considerable period of time piecing together the medical evidence to show that the client was unfit at the time of the incident and caution.</p>
<p>After setting out extensive representations to the police, they agreed that the caution had been wrongfully issued and agreed to the expungement  of the client&#8217;s PNC record.</p>
<p>This now means the client&#8217;s <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC record</a> is completely deleted, including his <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">DNA and fingerprints</a>.</p>
<p>We charged the client a reasonable fixed fee, which was agreed at the start of the case.</p>

<p>The police were called and wrongly arrested the client. The client was taken into custody and placed in a police cell.</p>
<p>After taking fingerprints and a DNA sample, the client was interviewed. After the interview a caution was offered which was agreed to by the client, who was anxious to return to her young children.</p>
<p>Little information was provided by the police with respect to the implications of the caution, and the client was rushed into making a very quick decision. It was only after the client was released from custody did she become aware of the significant implications of the caution.</p>

<p>We prepared detailed representations to the police, and who ultimately agreed with our arguments that the caution was inappropriate in the circumstances of the client’s case.</p>
<h2>Police Caution Removal Solicitors</h2>

<h2>Arrest Record Deletion</h2>
<p>Even if you have simply been arrested, namely you were arrested and detained, but the police took No further Action (NFA) against you, your details will appear on the PNC.</p>
<p>An arrest record can appear on an Enhanced Disclosure and Barring Service (DBS) certificate and can affect immigration applications.</p>
<h2>Disclosure and Barring Service (DBS) Children and Vulnerable Adults Barring</h2>
<p>A simple arrest, where no further action was taken, can sometimes precipitate an investigation and enquiry by the DBS into whether someone should be barred from working with children and vulnerable adults. If you have been arrested, and you then subsequently apply for an enhanced DBS certificate, information may be passed to the DBS, which could trigger a barring investigation.</p>
<p>If you have been cautioned or convicted of certain relevant crimes, then the DBS will undertake a barring investigation under their automatic barring procedure. Some automatic inclusion offences however permit an individual to make representations before they are barred.</p>
<p>We have had significant success in appealing auto-barring applications and applications where relevant information has been passed to the DBS.</p>
<p>We have also successfully had clients removed from the barred list where mistakes were made in the original barring decision, or where it was no longer appropriate to keep someone on the barred list after the minimum barring period has elapsed.</p>
