The police have been called, but by the time the police arrived the client&#8217;s partner did not support any action being taken.</p>
<p>The police nevertheless arrested our client and took her to the police station for questioning.</p>
<p>At the police station the client was advised to accept a police caution or face being prosecuted at court. As the client was a high profile businesswoman, court proceedings would have been seriously damaging to her career.</p>
<p>After being released from custody, and on discovering the implications the caution would have on her professional career, and also her ability to live and travel abroad, the client may contact with us.</p>
<p>On investigated the client&#8217;s case we discovered some failures in the police&#8217;s procedure, and advised the client that there was a case to argue for deletion.</p>
<p>Within a few months of submitting detailed representations to the police, the police force concerned agreed to expunge the client&#8217;s caution.</p>

The client had felt that he had always denied the allegation, but that he had been browbeaten into accepting the caution.</p>
<p>The client stated that he had been wrongly accused of being in possession of the cocaine, however in order to avoid being prosecuted, and to secure his quick release from the police station, he had accepted the caution.</p>
<p>At the time of accepting the caution the client did not anticipate having a career that would take him abroad. The client approached us as he wanted to move to the United States where his drugs caution would cause him serious difficulties in obtaining his Green Card. <p>We gathered together the client&#8217;s file from the police, and after our review of the evidence, we were able to determine that the client had a case for deletion of his caution. We promptly drafted detailed legal representations and submitted these to the police.</p>
<p>Within a relatively brief period of time, the police agreed to the deletion of the caution, the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC arrest record</a>, and the client&#8217;s <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">biometric data</a>.</p>

</div><div class="fusion-title title fusion-title-7 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">DNA and Fingerprints</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-8"><p>Along with retaining records on the PNC and PND, if you have been arrested for a <a href="https://policecautions.uk/2019/01/30/what-is-a-recordable-offence/">recordable offence</a>, and your case resulted in a caution or conviction, then the police can retain your <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">DNA and fingerprints on two systems (NDNAD and  IDENT1)</a> for varying periods of time, depending on a number of factors.</p>
</div><div class="fusion-title title fusion-title-8 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Non-Arrest Records</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-9"><p>If you were never arrested and your fingerprints and DNA were not taken, then your details will not be on NDNAD, IDENT1 or the PNC.</p>
<p>Nevertheless even if you  were questioned by the police without being arrested, or were simply suspected of being involved in an allegation, your records will likely be stored locally and/or on the PND for at least 6 years as &#8220;intelligence&#8221;.</p>
<p>Along with the PND, the MET also run the CRIMINT database, which stores intelligence information. In addition there is the National Domestic Extremism Database which has information on individuals who have been labeled domestic extremists, or who have been associated with domestic extremism and protests. The database formed part of the National Special Branch Intelligence System (NSBIS) which was replaced as part of a national programme known as Apollo, which created <a href="https://powerbase.info/index.php/National_Common_Intelligence_Application" target="_blank" rel="noopener">The National Common Intelligence Application (NCIA)</a>.</p>
</div><div class="fusion-title title fusion-title-9 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Can I obtain my Police Records?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-10"><p>You are entitled to have access to your records held by the police, you can apply to see what is held by undertaking a subject access request to the police force concerned. You can also undertake a <a href="https://www.acro.police.uk/s/acro-services/subject-access" target="_blank" rel="noopener">PNC check via ACRO</a> to see what is held on the PNC &#8211; an ACRO PNC check will also provide you information on your DNA and fingerprint records.</p>
<p>The information you obtain via a subject access request may be redacted by the police, namely it may be obscured or withheld on the basis that some of the information held also relates to &#8220;third parties&#8221;, and so can not be disclosed under Data Protection law. You may find that the police will black out or withhold a significant amount of information which you may feel is relevant to you.</p>

<p>The caution had been the result of a minor argument that became heated. The police were called and the client was taken away by the police to prevent any further incidents that evening. The client&#8217;s husband begged for the police not to arrest his wife, the police however still arrested the client due to their pro-active action policy in cases of domestic assault.</p>
<p>The client who was totally unfamiliar with legal proceedings, was completely shocked to be arrested and detained in a police cell. She was terrified of what the police might do, and how it might effect her work and immigration status. When the police offered her a police caution, she jumped at the chance, not understanding its full implications, simply wanting to leave the police station as fast as possible.</p>
</div><div class="fusion-title title fusion-title-11 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Police Caution Deletion</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-13"><p>Once she left the police station, and after having time to reflect on her situation, she researched the implications of the caution and was shocked to realise that it would be disclosed on DBS background checks, and would <a href="https://www.gov.uk/government/publications/good-character-nationality-policy-guidance" target="_blank" rel="nofollow noopener noreferrer">prevent her application for UK citizenship</a> for at least three years.</p>
<p>The client and her husband got in touch with us to  have her caution removed.</p>
<p>We promptly prepared detailed legal representations which persuaded the police to delete the client&#8217;s police caution from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a>.</p>
<p>Now that the client&#8217;s caution has been deleted, she has been able to process her application for citizenship and also has a clean <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">DBS certificate</a>.</p>

<p>Despite feeling that he had not committed a criminal offence, the client went along with the duty solicitor&#8217;s advice and made an admission to the allegation, and accepted a police caution. The client was worried had he not accepted the caution, he would have been charged and his case would have gone to court, and possibly appeared in the press.</p>
<p>On discussing the case with both the client and his wife, we prepared an application for deletion of the caution.</p>
<p>Initially the police refused to delete the caution, but after further representations were made, the police finally agreed to delete the client&#8217;s caution from the PNC.</p>
<p>The client&#8217;s standard DBS certificate is now clear and his name is entirely removed from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a> and his <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">biometric data</a> is deleted.</p>

<p>The client however stated to us that he had in fact been the victim of abuse by certain members of the public, and he had simply responded in kind to defend himself. At the police station he unfortunately received poor legal advice, and the police issued him with a caution. He was told that the caution would have a minimal impact on his future.</p>

<p>On leaving the police station the client did his own research and discovered the significant and multifarious impacts of the caution on him.</p>

<p>On reviewing the evidence it was clear to us that there had been some serious errors in the way the case been handled by the police, and we promptly set out our representations for expungement.</p>

<h1 class="wp-block-heading">Impact of a Police Caution</h1>

<p>It is often assumed that once you have received a police caution, nothing can be done about it. Whilst it is true that not all cautions can be deleted, it is sometimes the case that the police administer an unlawful caution, which will mean it can be deleted.</p>
<p>&nbsp;</p>
<p>There are a number of reasons for this to happen, often the police will be in a hurry to dispense with a case as quickly as possible, and may perceive a minor allegation as not being very important, and that a caution is also of little consequence to a detainee. It may also be the case that suspects are pressed into accepting a police caution for fear of being charged and going to court, and the consequent embarrassment and trauma that the court process can entail.</p>
