<p>The client worked in education and so required an enhanced DBS check. As the caution was for affray, it meant that it would forever be disclosed on both a standard and enhanced DBS check.</p>
<p>The caution was holding the client back from progressing in his career, and was finding that promising job offers were being withdrawn once it came to the background check phase of the recruitment process.</p>
<p>The caution had effectively resulted in the client accepting low paying teaching posts, with little prospects for promotion.</p>
</div><div class="fusion-title title fusion-title-1 fusion-title-text fusion-title-size-two"><div class="title-sep-container title-sep-container-left fusion-no-large-visibility fusion-no-medium-visibility fusion-no-small-visibility"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div><span class="awb-title-spacer fusion-no-large-visibility fusion-no-medium-visibility fusion-no-small-visibility"></span><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Legal Defects in the Police Caution Procedure</h2><span class="awb-title-spacer"></span><div class="title-sep-container title-sep-container-right"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-2"><p>After we reviewed the matter we were able to see that the police caution had been wrongly issued. The police had essentially issued a caution for affray where, at the very most, only an allegation of common assault was made out.</p>
<p>We argued that there were no members of the public that could have been caused fear for their safely, and importantly, that the incident had not occurred in a public place.</p>
<p>We prepared out submissions, setting out our findings to the police. Within a few months the police came back to us, stating that they had deleted he caution from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a>, and the client&#8217;s <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">DNA and fingerprints</a>.</p>
<p>Now that the police caution has been deleted, the client&#8217;s <a href="https://policecautions.uk/2019/11/03/can-you-appeal-a-dbs-check/">enhanced DBS</a> check is clear, and he is able to progress his career successfully.</p>

<p>Once a caution is issued it is immediately &#8220;spent&#8221; &#8211; save for a conditional caution which is generally spent after 3 months.</p>

<p>Even though your caution is &#8220;spent&#8221; it will still be retained on the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a>. The police will retain your caution on the PNC until you reach 100 years of age, unless your <a href="https://policecautions.uk/category/caution-removals/">police caution is deleted</a>.</p>
<p>The police can then disclose this caution on Disclosure and Barring Service (DBS) checks when you apply to work in sector that requires a higher level of trust such as law, finance or working with children and vulnerable adults.</p>

<p>Many countries require you to provide the police with an ACRO police certificate when applying for a long term Visa or Citizenship. </div><div class="fusion-title title fusion-title-5 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Can I go to America with a caution?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-7"><p>The strict letter of the law requires all police cautions to be disclosed to US authorities as they consider a police caution to be a conviction. Your caution will therefore make you ineligible to apply for a visa waiver (ESTA) and you will be required to attend at the US embassy for an interview.</p>
<p>The USA considers some cautions more serious than others, police cautions for the possession or supply of drugs, or ABH, will be considered to be convictions for offences of &#8220;moral turpitude&#8221; which will make you automatically ineligible for a Visa. You will then have to go through the waiver of ineligibility procedure.</p>

</div><div class="fusion-title title fusion-title-6 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Police Cautions and the sex offenders register</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-8"><p>If you have been, or are going to be issued with, a police caution for a sexual offence then you may be put on the Sex Offenders Register for two years.</p>
<p>Not all sexual offences require automatic notification and it will depend on the circumstances. For example with respect to sexual assault, if the offender is over 18 at the time, but the complainant is between 13 and 18 &#8211; then the notification requirements will apply. Similarly if you are given a caution for the possession of indecent images of children, and the child is under the age of 16, then the notification requirements will also apply.</p>
</div><div class="fusion-title title fusion-title-7 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Police Cautions and Re-offending</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-9"><p>A police caution can be mentioned at Court if you were to re-offend and be taken as evidence of &#8220;bad character&#8221;. The caution therefore could make it more likely that you would be convicted of a criminal offence if you were to re-offend.</p>
<p>Having a police caution will also make it less likely that the police would consider you eligible for a caution if you were to re-offend.</p>
<p>It is possible for people to receive multiple police cautions, however this is increasingly frowned upon and if you are rearrested, particularly if your caution was recent, then you stand a greater risk of being charged with a criminal offence.</p>
<p>You cannot be given a police caution if one has been issued in the previous two years unless there are exceptional circumstances as determined by an officer of at least the rank of inspector. Alternatively if you are not referred, but you subsequently apply for an <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">enhanced DBS check</a>, it is possible the DBS will consider placing you on the barred list.</p>

The police will exercise their power to disclose where there is a &#8220;pressing social need&#8221;:</p>

<p>The general presumption is that the police should maintain the confidentiality of personal information. The police do however possess a common law power to share personal sensitive information with third parties where a “pressing social need” can be established. A pressing social need might be the safeguarding, or protection from harm, of an individual, a group of individuals, or society at large.</p>

<p>If you do not plan on working in any profession that requires a standard or enhanced DBS check, and you are not concerned about the possible travel implications of a police caution, then perhaps a caution is not that serious &#8211; and might be considered a &#8220;slap on the wrists&#8221;.</p>
<p>If however you do work, or plan to work, in a trusted profession, or work/live overseas, then a police caution will not be a simple slap on the wrists.</p>

The client had been issued a police caution for theft.</p>
<p>The client had been issued an a caution for shoplifting a number of years ago.</p>
<p>The client had forgotten to pay for a small item from a well known shop, being distracted by her young child. On her way out of the shop the client was detained by the security staff. The security staff did not listen to her explanations and the police were summoned.</p>
<p>She was taken to the police station, misled about the impact of the caution, and decided to admit the allegation, and accept the caution in order to escape from police custody.</p>
<p>The client had tormented herself for many years about the caution, regretting her decision to accept it, and felt the caution was an unfair black mark against her name.</p>

<p>Within several months the police acknowledged the caution had been unfairly issued, and agreed to the expungement of the client&#8217;s record.</p>

<p>When the client was at the police station he did not have any legal advice, and was effectively railroaded into accepting the caution by the police. His family was misled about the applications of the caution, and agreed to its imposition.</p>

<p>We presented our findings to the police, who promptly agreed to the compete deletion of the client’s PNC record and biometric data.</p>
<p>Now that the caution is deleted the client’s DBS check will be clear, also his ACRO Police Certificate will now state “no trace” as opposed to “no live trace”.</p>

The police must state the caution before any questions about an offence can be asked. The CODE C Guidance to the Police and Criminal Evidence Act 1984 (PACE) states the following:</p>
</div><div class="fusion-reading-box-container reading-box-container-2" style="--awb-title-color:#18b38c;--awb-margin-top:0px;--awb-margin-bottom:20px;"><div class="reading-box" style="background-color:#f6f6f6;border-width:1px;border-color:#f6f6f6;border-left-width:3px;border-left-color:var(--primary_color);border-style:solid;"><div class="reading-box-additional">
<p>A person whom there are grounds to suspect of an offence, see Note 10A, must be cautioned before any questions about an offence, or further questions if the answers provide the grounds for suspicion, are put to them if either the suspect’s answers or silence, (i.e. failure or refusal to answer or answer satisfactorily) may be given in evidence to a court in a prosecution.</p>
</div><div class="fusion-clearfix"></div></div></div><div class="fusion-text fusion-text-22"><p>The police do not need to make an arrest in order to caution someone, often people will be interviewed by the police as “volunteers” and will not be placed under arrest. Prior to the commencement of an interview a suspect will be “cautioned”, namely read their rights. The caution&#8217;s wordings is as follows:</p>

<p>You do not have to say anything. But it may harm your defence if you do not mention when questioned something which you later rely on in Court. Anything you do say may be given in evidence.</p>
</div><div class="fusion-clearfix"></div></div></div><div class="fusion-text fusion-text-23"><p>If a suspect is being interviewed as a volunteer, if they decide to leave their “voluntary” interview, they will most likely be arrested in order for their questioning to continue.</p>
<p>Being arrested does carry some significant impacts, most notably in terms of any long-term consequences, the police will usually create an arrest record which will be logged onto the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">Police National Computer (PNC)</a>. A PNC record can be disclosed on an <a href="https://policecautions.uk/enhanced-dbs/">enhanced DBS certificate</a>.</p>
</div><div class="fusion-title title fusion-title-18 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Simple Police Cautions</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-24"><p>A caution, or a simple police caution, is very difference from “the police caution” – a simple caution is record of an offence where an individual has admitted an allegation. Typically they will be issued for low level offending such as assault, minor drugs cases, shoplifting, minor public order offences, and low-level harassment cases.</p>
<p>A police caution will be retained on the PNC for 100 years, unless it is deleted, and can be disclosed in relation to <a href="https://policecautions.uk/dbs-appeal/">certain background checks</a>.</p>
<p>Along with the simple adult police caution, there are also conditional cautions, which attach conditions to the caution, such as paying a fine or making an apology. There are also youth cautions and youth conditional cautions for offenders under the age of 18.</p>

<p>Both cautions had occurred a number of years ago when the client was young. Since that time he had developed a successful professional career, and had entirely moved on from his past.</p>
<p>The cautions however were preventing him from obtaining permanent residency overseas.</p>
<p>The police initially refused to delete the caution, however after making further detailed representations, the police overturned their original decision, and expunged the client&#8217;s caution.</p>
<p>Now that the client has had both of his caution&#8217;s deleted, his <a href="https://policecautions.uk/2019/03/24/what-is-a-police-certificate/">ACRO police certificate</a> now states &#8220;no trace&#8221;.</p>

<p>The PNC is an amalgam of a number of databases containing text information relevant to policing. Fingerprints and DNA are not placed onto the PNC, but a reference to these items is logged against names files which link to the <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">National Fingerprint Database (IDENT1) and the National DNA Database (NDNAD)</a>.</p>
<p>The PNC is different to the <a href="https://policecautions.uk/2019/01/28/what-is-the-police-national-database-pnd/">Police National Database (PND)</a>, which is a repository of &#8220;local&#8221; police force information know as &#8220;soft&#8221; intelligence, for example details of criminal investigations that did not lead to a conviction.</p>
<p>Along with individual &#8220;Names&#8221; files, there are also vehicle files, which contains information from the DVLA regarding ownership, tax records, and other vehicle records. Crime reports can also be attached to these vehicle records.</p>
<p>There are also property files where certain types of stolen property can be listed, also there are driver files which contains driver licence records.</p>
<p>Along with providing real time checks on people, vehicles, crimes and property, the PNC also links in with the European-wide IT system called Schengen Information System (SIS II) that enables all participating member states to share real-time information on persons and objects of interest via a series of &#8216;Alerts&#8217;. These SIS II alerts are for:</p>
<ul>
<li>Persons wanted for extradition</li>
<li>Missing persons</li>
<li>People wanted for judicial purposes</li>
<li>People or vehicles requiring discreet checks </li>
<li>Misappropriated, lost or stolen objects sought for the purposes of seizure or providential purposes .</li>
</ul>

<h2 class="wp-block-heading">Who has Access to the PNC?</h2>
<p>The PNC is available to all police forces and law enforcement agencies throughout England, Scotland, Wales, Northern Ireland, the Isle of Man, the Channel Islands.</p>
<p>Along with law enforcement agencies, a <a href="https://whatdotheyknow.com/request/511705/response/1236085/attach/3/147%2018%20Response%20Letter.pdf?cookie_passthrough=1" target="_blank" rel="noreferrer noopener" aria-label="number of other agencies are also permitted access to the PNC (opens in a new tab)">number of other agencies are also permitted access to the PNC</a>. These include, amongst many others, the Disclosure and Barring Service (DBS), HM Prison Service, HMRC, the House of Commons, the House of Lords, the Home Office, and Royal Mail.</p>
<h2 class="wp-block-heading">Names Files</h2>
<p>In respect of <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/488515/PNC_v5.0_EXT_clean.pdf" target="_blank" rel="noreferrer noopener" aria-label="individuals, the PNC holds information (opens in a new tab)">individuals, the PNC holds information</a> in relation to people who are, or were, of interest to UK law enforcement agencies because they:</p>
<ul>
<li>have convictions/cautions (including youth warnings/reprimands) for criminal offences</li>
<li>are subject to the legal process, for example waiting to appear at court</li>
<li>are wanted</li>
<li>have certain court orders made against them</li>
<li>are missing or have been found</li>
<li>have absconded (escaped) from specified institutions</li>
<li>are disqualified from driving by a court</li>
<li>have a driver record held at the Driver and Vehicle Licensing Agency (DVLA)</li>
<li>hold a firearm certificate.</li>
</ul>
<h2 class="wp-block-heading">Can I Check the PNC?</h2>
<p>You can check the PNC but only in relation to your own information, or if you have express authority (a third party request) to do so by another individual; see <a href="https://www.acro.police.uk/Subject_Access_Online.aspx" target="_blank" rel="noreferrer noopener" aria-label="here to check your PNC records (opens in a new tab)">here to check your PNC records</a>.</p>
<h2 class="wp-block-heading">How long are Police Records held on the PNC?</h2>
<p>If you have been issued with an arrest record, police caution, conditional caution, youth caution, youth conditional caution, reprimand or final warning then these records will be retained on the PNC until you are deemed to be 100 years of age, effectively for life.</p>
<h2 class="wp-block-heading">Can you Delete Police Records off of the PNC?</h2>
<p>It is possible to have cautions and other police disposals deleted from the PNC, if you are able to evidence good grounds for deletion. If you can show, for example, that the a police caution was unlawfully issued, or perhaps that it is not in the public interest, the caution may be deleted from the PNC.</p>

He had been with his partner for several years, however the relationship ended badly with accusations made on both sides.</p>
<p>The police chose to believe the ex-partner&#8217;s version of events and accused the client of harassment and stalking. Our client was a successful professional who was required to undertake <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">DBS checks</a> and also <a href="https://policecautions.uk/2019/03/24/what-is-a-police-certificate/">travel abroad</a> on short/medium work contracts. The client also was frequently involved in charity work where he was required to undertake an <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">enhanced DBS check</a>.</p>
<p>The caution therefore caused our client significant difficulties, and had it remained in place would have seriously jeopardised his professional career and charitable work. The client stated at the time the caution was issued to him he was told that it would have no long term impact.</p>

<p>On reviewing the evidence we were able to determine that the police&#8217;s investigation had been very one-sided, and they had not followed up important aspects of the case which showed inconsistencies in the complainant&#8217;s evidence. The client&#8217;s police station interview was also clearly equivocal &#8211; despite these defects the police had still offered the client a caution.</p>
<p>After presenting our findings to the police, and then appealing the case, the police agreed to delete the caution. The client&#8217;s caution, <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC record</a> and <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">biometrics</a> are now deleted.</p>

<p>The client had an argument with his wife, and the police were called by the neighbours. Despite his wife not supporting any action being taken, the police arrested our client and took him to the police station.</p>
<p>Despite feeling that he had not committed a criminal offence, the client went along with the duty solicitor&#8217;s advice and made an admission to the allegation, and accepted a police caution. The client was worried had he not accepted the caution, he would have been charged and his case would have gone to court, and possibly appeared in the press.</p>
<p>On discussing the case with both the client and his wife, we prepared an application for deletion of the caution.</p>
<p>Initially the police refused to delete the caution, but after further representations were made, the police finally agreed to delete the client&#8217;s caution from the PNC.</p>
<p>The client&#8217;s standard DBS certificate is now clear and his name is entirely removed from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a> and his <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">biometric data</a> is deleted.</p>
