<p>The client had been issued an a caution for shoplifting a number of years ago.</p>
<p>The client had forgotten to pay for a small item from a well known shop, being distracted by her young child. On her way out of the shop the client was detained by the security staff. The security staff did not listen to her explanations and the police were summoned.</p>
<p>She was taken to the police station, misled about the impact of the caution, and decided to admit the allegation, and accept the caution in order to escape from police custody.</p>
<p>The client had tormented herself for many years about the caution, regretting her decision to accept it, and felt the caution was an unfair black mark against her name.</p>
</div><div class="fusion-title title fusion-title-1 fusion-title-text fusion-title-size-two"><div class="title-sep-container title-sep-container-left fusion-no-large-visibility fusion-no-medium-visibility fusion-no-small-visibility"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div><span class="awb-title-spacer fusion-no-large-visibility fusion-no-medium-visibility fusion-no-small-visibility"></span><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Theft Caution Deleted</h2><span class="awb-title-spacer"></span><div class="title-sep-container title-sep-container-right"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-2"><p>On reviewing the police&#8217;s evidence, we concluded that there were some material errors in her case, and so we drafted a deletion application to the police.</p>
<p>Within several months the police acknowledged the caution had been unfairly issued, and agreed to the expungement of the client&#8217;s record.</p>
<p>The caution was completely deleted, as was the client&#8217;s <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a> record, <a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/">fingerprints and DNA records</a>.</p>
<p>The client now has a completely clear record on the PNC and is &#8220;no trace&#8221; on an <a href="https://policecautions.uk/2019/03/24/what-is-a-police-certificate/">ACRO Police Certificate</a>.</p>

<p>The client had been suffering from a serious mental illnesses at the time of the caution. We therefore argued that our client had been <a href="https://en.wikipedia.org/wiki/Insanity_in_English_law" target="_blank" rel="noopener noreferrer">legally insane according to the &#8220;M&#8217;Naghten Rules&#8221;.</a></p>

<p>The client however stated to us that he had in fact been the victim of abuse by certain members of the public, and he had simply responded in kind to defend himself. At the police station he unfortunately received poor legal advice, and the police issued him with a caution. He was told that the caution would have a minimal impact on his future.</p>

<p>On leaving the police station the client did his own research and discovered the significant and multifarious impacts of the caution on him.</p>

<p>On receiving the client&#8217;s instruction we immediately set about obtaining the client&#8217;s file from the police and also the solicitor.</p>

<p>On reviewing the evidence it was clear to us that there had been some serious errors in the way the case been handled by the police, and we promptly set out our representations for expungement.</p>

<h1 class="wp-block-heading">Impact of a Police Caution</h1>
<p>&nbsp;</p>
<p>It is often assumed that once you have received a police caution, nothing can be done about it. Whilst it is true that not all cautions can be deleted, it is sometimes the case that the police administer an unlawful caution, which will mean it can be deleted.</p>
<p>&nbsp;</p>
<p>There are a number of reasons for this to happen, often the police will be in a hurry to dispense with a case as quickly as possible, and may perceive a minor allegation as not being very important, and that a caution is also of little consequence to a detainee. It may also be the case that suspects are pressed into accepting a police caution for fear of being charged and going to court, and the consequent embarrassment and trauma that the court process can entail.</p>

<p>If you feel you have been the victim of an unfair caution, and you only accepted the caution because you felt it was the easiest thing to do at the time, or you just wanted to get out of the police station as soon as possible, then please get in touch.</p>

					<description><![CDATA[<p>Currently, England and Wales have no formal process for “sealing” a criminal record. There is no procedure to apply to a Court to have a criminal record formally sealed so it is not disclosed. There is also no formal process for expunging a criminal record (other than police records), namely erasing someone’s criminal record.</p>

There is no procedure to apply to a Court to have a criminal record formally sealed so it is not disclosed.</span></p>
<p><span style="font-weight: 400;">There is also no formal process for expunging a criminal record (other than police records), namely erasing someone’s criminal record. In the United States, there are laws on sealing records and expungement; the rules vary from state to state.</span></p>
</div><div class="fusion-title title fusion-title-5 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Recommendations for Sealing Criminal Records</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-9"><p><span style="font-weight: 400;">It has been recently suggested (September 2017) that the UK adopt a similar approach to the United States. A report commissioned by former Prime Minister David Cameron and headed by David Lammy MP (the Lammy review) recommended that former offenders should be able to apply for their criminal records to be sealed. The report recommends that ex-offenders should be able to apply to have their case heard by a judge or independent body, such as the Parole Board, where they could prove they have reformed.</span></p>
<p><span style="font-weight: 400;">The judge would then decide whether to “seal” the record, having considered factors such as time since the offence and evidence of rehabilitation. If the decision goes the applicant’s way and the criminal record is sealed, the record will still exist, but the individual would not need to disclose it, and employers would not be able to access it.</span></p>
</div><div class="fusion-title title fusion-title-6 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Current Disclosure System</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-10"><p><span style="font-weight: 400;">Whether the suggestions for reforming the disclosure system incorporating a sealing process will be implemented is yet to be seen.</span></p>
<p><span style="font-weight: 400;">However, there are already in place rules that protect former offenders from disclosing certain criminal records.</span></p>
<p><span style="font-weight: 400;">These rules are often reviewed, particularly after successful legal challenges before the High Court. Legal challenges have resulted in several improvements for former offenders.</span></p>
<p><span style="font-weight: 400;">The Disclosure and Barring Service’s (DBS) disclosure rules, as currently in place, permit disclosure on a DBS certificate in the following circumstances:</span></p>

<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Caution for specified offence </span><span style="font-weight: 400;">18 or over</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Caution for non-specified offence</span> <span style="font-weight: 400;">18 or over</span> <span style="font-weight: 400;">Less than 6 years</span></li>

<p><span style="font-weight: 400;">The list of serious specified offences that permit permanent disclosure by the DBS includes a range of serious offences that are related to sexual or violent offences or are relevant in the context of safeguarding. </span></p>
</div><div class="fusion-title title fusion-title-7 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Police Records vs Court Records</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-11"><p><span style="font-weight: 400;">Suppose you have only a police record, namely a PND, a police caution (simple or conditional), a cannabis warning, or a police arrest record. In that case, you will be able to apply to the police directly to have these records </span><a href="https://www.policecautions.uk/expunging-police-caution-students/"><span style="font-weight: 400;">“expunged” (deleted) from the PNC</span></a><span style="font-weight: 400;">.</span></p>
<p><span style="font-weight: 400;">If you have been to court and have been convicted, you will not be able to “expunge” a record but will be able to appeal your conviction. If your appeal is successful and your conviction is quashed, then you could apply to have your PNC records expunged.</span></p>
<p><span style="font-weight: 400;">The police will only delete a police record if certain considerations apply, such as false or malicious allegation that an arrest was unlawful, the case was incorrectly disposed of, or in the wider public interest.</span></p>
<p><span style="font-weight: 400;">If the police agree to delete your PNC record, your biometric data (DNA and fingerprints) will also be expunged.</span></p>
<p><span style="font-weight: 400;">If the police refuse to delete your PNC record, it will be retained on the PNC for 100 years, effectively for life. Suppose you need to prepare to accept the retention of your record on the PNC. In that case, if certain considerations apply, you can apply to the High Court for Judicial Review of the decision to retain the record. Also, in certain circumstances, you may be able to apply to the Information Commissioner’s Office (ICO) to decide whether your data ought to be retained by the police.</span></p>
</div><div class="fusion-title title fusion-title-8 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Disclosure and Barring Service (DBS) Certificates and Suppression of Information</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-12"><p><span style="font-weight: 400;">If you are required to undertake a DBS certificate, if your records are protected according to the rules detailed above, e.g. after 6 years with respect to a police caution, then nothing will show up on a DBS certificate unless the caution is for a proscribed list offence (such as ABH, child neglect/cruelty, sexual assault).</span></p>
<p><span style="font-weight: 400;">However, if you require an </span><a href="https://www.policecautions.uk/enhanced-disclosure-and-barring-service-certificate-dbs/"><span style="font-weight: 400;">enhanced DBS certificate</span></a><span style="font-weight: 400;">, even after 6 years of caution, and even for offences not on the specified offences list. In that case, it is still possible for information related to the caution to be disclosed on an enhanced DBS certificate. If information is disclosed, you can appeal this disclosure directly to the DBS in the first instance and then, if that fails, to a body called the Independent Monitor. If the Independent Monitor rules against you, you can appeal to the Upper Tribunal.</span></p>

<p>We gathered together supporting evidence, and presented the client’s case to the police, which resulted in the police agreeing to the removal of the caution from the Police National Computer (PNC).</p>
<p>Regulatory investigations have now been dropped against our client, who has now returned to work with a clean record. Had the caution not been removed, as it was Actual Bodily Harm (ABH), which is on a list of offences that will never become filtered by the <a href="https://www.policecautions.uk/dbs-appeal/">Disclosure and Barring Service (DBS)</a>, it would have been disclosed forever and would have been retained on the PNC for 100 years.</p>

<p>The police agreed with our assessment of the evidence, and reviewed the file again, resulting in the deletion of the client’s police caution, PNC record, fingerprints and biometric data.</p>
<p>Now that the record is removed, the client will have a clear DBS certificate and will be able to apply for roles without the fear of having damaging information disclosed.</p>

<p><span style="font-weight: 400;">The National Police Chiefs’ Council (NPCC) calls this process the “Record Deletion Process.” Locally held records, such as custody records and custody photos, are managed under the Authorised Professional Practice (APP)—Information Management Policy.</span></p>
<p><span style="font-weight: 400;"> Previously, there was no coordinated procedure for deleting police records, you would need to write to the chief constable of the relevant police force and ask for records, such as arrest records and police cautions, to be deleted.</span></p>
<p><span style="font-weight: 400;">The NPPC has created a process whereby applications for deletion are sent through a centralised unit called the National Records Deletion Unit, which is part of ACRO’s Criminal Records Office.</span></p>
<p><span style="font-weight: 400;">You cannot use the early records deletion process to delete court convictions—if you wish to remove a conviction, you will need to challenge it in Court.</span></p>
<h2>Can Biometric Data Be Deleted From Police Records?</h2>
<p><span style="font-weight: 400;">If you have been convicted (including cautioned) of a criminal offence, you </span><b>will not</b><span style="font-weight: 400;"> have an automatic right to have your Biometric data records deleted. Biometric data is your </span><a href="https://policecautions.uk/2019/01/30/how-long-can-the-police-keep-my-dna-and-fingerprints/"><span style="font-weight: 400;">DNA profile and fingerprints</span></a><span style="font-weight: 400;">. If you were a youth at the time, your fingerprints and DNA will be deleted after five years (plus the length of any custodial sentence) unless the offence is a “Qualifying Offence” or indefinitely if your custodial sentence was five years or more or if you have two convictions.</span></p>
<p><span style="font-weight: 400;">If you were acquitted of an offence, even if you were charged, you have a right to have your biometric records deleted. The period after which records will be deleted is set out according to the type of offence and, in some cases, can be extended if an application is made to extend the retention period. For example, suppose you were arrested or charged but not convicted/cautioned for a minor offence. In that case, your biometric records will be deleted immediately (although a speculative search will be undertaken before their destruction).</span></p>
<h2>Early Deletion of Biometric information and PNC Record</h2>
<p><span style="font-weight: 400;">If you provide good reasons, and the chief officer agrees, you can apply to have your biometric data deleted early.</span></p>
<p><span style="font-weight: 400;">You can also use the record deletion process to delete PNC records, including expunging police cautions and arrest records, providing there is evidence of good grounds for the record’s removal. A police caution can be expunged, but the police can still retain the PNC arrest record. <h2>Are There Grounds For Early Police Record Deletion?</h2>
<p><span style="font-weight: 400;">Yes, there are several grounds for early deletion. They have been set out by the NPCC as follows:</span></p>
<h3>Unlawfully Taken</h3>
<p><span style="font-weight: 400;">Where you believe your DNA or fingerprints were taken unlawfully. For example, this might apply if your arrest was unlawful.</span></p>
<h3>Mistaken Identity</h3>
<p><span style="font-weight: 400;">Where you believe that your arrest was unlawful or was based on you being mistakenly identified.</span></p>
<h3>Malicious/False Allegation</h3>
<p><span style="font-weight: 400;">Where you have been arrested and charged, but the case has been withdrawn at any stage, and there is corroborative evidence that the case was based on a malicious or false allegation.</span></p>
<h3>Proven Alibi</h3>
<p><span style="font-weight: 400;">Where there is corroborative evidence that you have a proven alibi and, as a result, have been eliminated from the enquiry after being arrested.</span></p>
<h3>Incorrect Disposal</h3>
<p><span style="font-weight: 400;">Where the disposal options applied by the Police following your arrest have been administered incorrectly, for example, a police caution may have been improperly administered.</span></p>
<h3>Suspect&#8217;s Status Was Not Clear at the Time of Arrest</h3>
<p><span style="font-weight: 400;">You were arrested at the outset of an enquiry where the circumstances and distinction between the offender, victim, and witness are unclear, and you were subsequently eliminated as a suspect (but you may be a witness or victim).</span></p>
<h3>Judicial Recommendation</h3>
<p><span style="font-weight: 400;">If, in the course of court proceedings, a Magistrate or Judge makes a recommendation that your DNA, fingerprints or PNC record should be deleted.</span></p>
<h3>Another Person Was Convicted of the Offence</h3>
<p><span style="font-weight: 400;">The conviction of another person for the offence may constitute grounds for the deletion of your DNA, fingerprints, and PNC record.</span></p>
<h3>Public Interest</h3>
<p><span style="font-weight: 400;">These are instances where you believe the Chief Officer should determine that there is a wider public interest in deleting your DNA, fingerprints or PNC record.</span></p>
<h2>What Other Reasons Impact Police Record Deletion?</h2>
<p><span style="font-weight: 400;">There are additional factors that will affect a record deletion application. These are:</span></p>
<ul>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Whether there are ongoing investigations or court proceedings.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">If there is an application to extend the retention period with respect to biometric data.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">If there are other court convictions.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">The police may have felt you were culpable but could not prove the allegation.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">The police may decide that although an allegation was not provable according to the criminal standard (beyond all reasonable doubt/so that it is sure), they strongly feel you were likely guilty.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Positive evidence of being eliminated as a suspect – if compelling evidence shows you were not the guilty party, then this will tend to support deletion.</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">The retention of biometric information due to a previous conviction.</span></li>

<p>A caution will become an issue for someone depending on who is asking the question, and the powers they have to ask about previous criminal records.</p>
<p>A caution is &#8220;spent&#8221; immediately (or after three months, or when the conditions run out, in respect of a conditional caution). So for the purposes of a Basic DBS certificate a police caution (sometimes known as a simple caution), will not be disclosed.</p>

<p>A conditional police caution will be spent once the conditions end or after 3 months, whichever is sooner. A caution however will show up for longer periods of time on Standard and Enhanced DBS certificates and in some cases may be disclosed forever. <p>If  your adult caution was for a <a href="https://www.gov.uk/government/publications/dbs-list-of-offences-that-will-never-be-filtered-from-a-criminal-record-check" target="_blank" rel="noopener">specified offence</a> it will show up indefinitely on a standard (and enhanced) Disclosure and Barring Service (DBS) certificate. Most offences that appear on the proscribed list you would be unlikely to receive a caution for, offences include murder, terrorism and <a href="https://policecautions.uk/2025/03/26/deletion-of-arrest-records-for-rape-allegations/">rape</a>. However there are a certain number of offences that are on the specified list that can easily apply to facts that are relatively minor, offences such as Actual Bodily Harm (ABH), child cruelty or burglary. Whilst these offences can at times relate to more serious factual incidents, sometimes cautions can be issues for these offences where the facts are relatively minor. Examples might be causing a minor cut or bruise to someone during a domestic fight, leaving your child unattended for a short period of time or a burglary allegation when a youth and of a low value and type, for example entering an abandoned home and taking something of low value.</p>

<p>On an <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">enhanced DBS certificate</a>, a police caution will definitely show up for 6 years, after which it will be protected and will most likely be filtered off of a DBS certificate. If however your caution is for an offence on the proscribed list of offences that never become filtered, then your caution will never become protected and it will always appear on your DBS certificate.</p>
<p><em><strong>NB, November 2020 edit: </strong>Youth cautions, warnings and reprimands are immediately  &#8220;protected&#8221; subsequent to changes implemented by the government. <p>Even if your caution is not for a proscribed list offence and so will be eligible for filtering, the police retain a broad discretion in terms of the information they can disclose on an enhanced DBS certificate. So even of your caution was for a minor common assault, or a minor theft, the police, if they feel the caution reveals facts that are relevant to your job application, then they may disclose relevant facts on your certificate. If information related to your caution is disclosed after the 6 year period, as long as it is not for a proscribed list caution, you may appeal the disclosure of this information.</p>

<p>The Criminal Records Office issues certificates that are used by UK citizens looking to emigrate to foreign nations.</p>
<p>The Criminal Records Office adopt the &#8220;step down&#8221; model, as opposed to the filtering process used by the Disclosure and Barring Service. The step down process removes cautions from a certificate after certain periods of time. A serious caution will be removed after 10 years, a caution for a more minor offence will be removed after 5 years.</p>
