Since our last update we have had over 50 police cautions and arrest records deleted.

Each case has turned on its own particular facts, and deletion decisions, have been taken across the length and breadth of England and Wales.

Along with these Police National Computer (PNC) deletion decisions we have also also successfully applied for the remove of local police records, challenged disclosures on enhanced DBS certificates, and successfully challenged DBS barring decisions.

Today however was our most successful day yet as we received notice from the police that police cautions had been deleted from the PNC with respect to 5 separate cases.

Each case related to 5 different police forces, and 5 separate sets of facts.

1. Domestic Assault Police Caution Deleted

This caution was deleted with respect to a domestic dispute allegation. There were a number of defects in the police’s case, and the client’s husband (who was the purported victim) supported the deletion.

2. Fraud Police Caution Deleted

This police caution had been issued a number of years ago. Despite the time that had elapsed we were able to piece together the case, and show the police that the police caution was being unfairly retained.

3. Drugs Police Caution Removed

This case related to the possession of class A drugs. The caution had a devastating emotional impact on the client, and despite it being issued several years ago, the client relived their arrest on a daily basis. It was no exaggeration to say the arrest had turned the client’s life upside down. We were able to persuade the police that the caution was unfair and ought to be deleted.

4. Robbery Police Caution Deleted from the PNC

This police caution had been issued a number of years ago, but as it was for robbery, it was permanently disclosable on both a standard and enhanced DBS check. We were able to present evidence that showed the caution ought to be deleted by the police.

5. Sexual Police Offence Caution Expunged

This police caution had been issued recently and related to a relatively serous sexual allegation. The client had been offered the caution on the basis that he was fortunate to avoid prosecution, and thereby a humiliating court case. Despite accepting the caution, his details were nevertheless plastered over the internet, and his employer found out – resulting in the loss of his employment. We reviewed the evidence and concluded there had been some serious errors in the police’s conduct of the case. We prepared extensive and detailed representations. Within a matter of weeks the police had communicated to us that they had deleted the police caution. Now the record is removed from the PNC the client is able to resume work and get back on with his life.

Enhanced DBS Certificate Appeals

Along with successfully appealing 5 police cautions, we also received notice today that two separate enhanced DBS certificate appeals were successful.

1. Chief Constable Representations for Medical Professional

One case related to the disclosure of a domestic incident that had resulted in no further action being taken. The client was a medical professional and so if the incident was disclosed on the client’s certificate, it would have had a devastating impact.

We made careful and prompt representations to the police, pointing out the factual inconsistencies in the evidence, set against the law related to the disclosure of non-conviction records. The police promptly concluded the incident ought not to be disclosed, and issued a clean DBS check.

2. Enhanced DBS Certificate Appeal for Medical Student

The other matter related to a sibling incident where the client had received a community resolution. The incident was low level, but the police felt the allegation had raised some safeguarding issues. We pulled together detailed representations, setting out why it would be unfair to disclose the community resolution, and the purported facts behind it. After several months of waiting and chasing the police, they finally agreed to remove the information from the certificate.

The client now has a clean enhanced DBS certificate and is making plans to enroll in medical school.

Our lawyers also have extensive experience in challenging DBS barring decisions; both appealing existing barrings, or resisting a new barring application.

We are also able to help if you are being investigated by a regulator including the General Medical Council (GMC), the Nursing and Midwifery Council (NMC), the Health Care Professions Council (HCPC), the General Pharmaceutical Council (GPhC), Medicines and Healthcare products Regulatory Agency (MHRA), the General Optical Council (GOC), the Association of Accounting Technicians (AAT), the Association of Chartered Certified Accountants (ACCA), the General Dental Council (GDC), the General Osteopathic Council (GOsC), Institute of Chartered Accountants in England and Wales (ICAEW), the Royal College of Veterinary Surgeons (RCVS), and the Teaching Regulation Agency (TRA).

The allegation was a very low level incident of “theft by finding” during a University night out with friends.

The client and his friends had taken an item of property they had thought was discarded. The client had seen the item lying in what appeared to be some rubbish, and had not dishonestly taken it.

The incident was however reported by the police, and the client and his friends were investigated. They were all accused of theft, and due to a fear of being taken to court, the client, and his friends, accepted police cautions.

The client felt he had denied the allegation, but just agreed to the police caution to escape from the police. He was told the police caution would have no impact on his future.

Expert Police Caution Deletion Solicitors

The client came to learn after the caution was issued that it would cause him serious issues when applying for a Green Card to the Untied States. A caution for theft is considered a conviction for “moral turpitude” and was advised by US attorneys to challenge the police caution.

The caution would be indirectly indefinitely disclosed on an ACRO Police Certificate as a “no live trace” disclosure. A “no live trace” disclosure will tell a foreign nation that the person has a criminal record, and will, for countries such as the USA, China, Saudi Arabia, Canada, and Singapore, precipitate a request for further details about that person’s background.

We obtained the records from the police and were quickly able to prepare a deletion application. We argued that the police caution had been unfairly issued, and that the caution ought to be expunged from the PNC.

The police responded by completely deleting the client’s record from the PNC, and also deleting his DNA and fingerprints.

The police have been called, but by the time the police arrived the client’s partner did not support any action being taken.

The police nevertheless arrested our client and took her to the police station for questioning.

At the police station the client was advised to accept a police caution or face being prosecuted at court. As the client was a high profile businesswoman, court proceedings would have been seriously damaging to her career.

After being released from custody, and on discovering the implications the caution would have on her professional career, and also her ability to live and travel abroad, the client may contact with us.

On investigated the client’s case we discovered some failures in the police’s procedure, and advised the client that there was a case to argue for deletion.

Within a few months of submitting detailed representations to the police, the police force concerned agreed to expunge the client’s caution.

The incident arose out of a domestic dispute, and over a shared item of property. During the course of the argument the item of property was damaged.

Due to the noise of the argument, the neighbours had called the police.

At the police station the client informed the police that the damaged item was shared property, the police chose nevertheless to offer the client a police caution. The client believing that the caution would have no long-term implications, accepted it.

The client subsequently discovered, on applying for a green card to the United States, that the caution would be retained until she reached 100 years of age, and that it would be disclosed on an ACRO police certificate.

After the client instructed us we reviewed the evidence in her case and concluded that she had a basis to argue for expungement.

We promptly drafted representations and in due course the police agreed to delete the caution, the associated PNC record, the fingerprints and DNA, and also the custody image.

The client had felt that he had always denied the allegation, but that he had been browbeaten into accepting the caution.

The client stated that he had been wrongly accused of being in possession of the cocaine, however in order to avoid being prosecuted, and to secure his quick release from the police station, he had accepted the caution.

At the time of accepting the caution the client did not anticipate having a career that would take him abroad. The client approached us as he wanted to move to the United States where his drugs caution would cause him serious difficulties in obtaining his Green Card. For details on travel to the United States please visit here: United States Waiver of Ineligibility & Criminal Records.

We gathered together the client’s file from the police, and after our review of the evidence, we were able to determine that the client had a case for deletion of his caution. We promptly drafted detailed legal representations and submitted these to the police.

Within a relatively brief period of time, the police agreed to the deletion of the caution, the PNC arrest record, and the client’s biometric data.

Subsequently we also applied for the deletion of the PND local records retained by the police; the police also agreed to delete these records.

Our client had an argument with her husband which resulted in the police being called. When the police arrived the client’s husband did not want his wife to be arrested, however the police insisted on arresting and taking our client into detention.

Although the husband did not provide a signed statement, the police were able to base their case on the original 999 call that had been made to them.

The police threatened the client with prosecution if she did not accept a police caution. Concerned for her career, and the possibility of going to prison, the client accepted a police caution.

Since receiving the caution the client has had significant difficulty in progressing her career, which not only impacted her, but the rest of her family.

Upon receiving the client’s instructions we investigated the case with the police, and then prepared detailed representations.

The police, after consideration, agreed to delete the client’s police caution, which is now no longer being revealed on her DBS certificate.

The client was an international student and originated from a country where pepper spray was legal and widely available.

The client had been in the UK for a number of years and had always had the pepper spray in her possession, and had frequently traveled through Customs into the UK carrying the spray in her hand luggage. On no previous occasion had the client been questioned about the pepper spray, and was completely unaware that it was illegal.

The client was stopped during a routine search into an official premise, whereupon the spray was discovered. The police were quickly summoned, and very shortly afterwards a police caution was issued.

As the client hoped to work in a regulated environment, and had spent many years studying towards this goal, the imposition of the caution would have been extremely detrimental to her career. Pepper spray is classified as a firearm under UK law, and so any disclosure of the caution on a DBS certificate would state that an offence had been committed under firearms legislation.

Despite there being no legal defence in the client’s case, we were however able to successfully persuade the police to expunge the client’s caution, PNC arrest record, and biometric data.

We applied to the police for the client’s records, and even though the caution have been issued a number of years ago, and the amount of evidence was fairly limited, we were able to identify a very clear breach of the police caution guidance.

The police promptly acknowledged that they had made an error and expunged the client’s caution, PNC arrest record, and his biometric data.

Now that the caution is deleted, the client’s ACRO police certificate will state “no trace”.

The client was been said to have left her children alone for a period of time when they had both been under the age of 10 years old.

At the time the client had just gone through an acrimonious separation, and was dealing with becoming a single mother in difficult financial circumstances.

After rebuilding her life she looked to move into a regulated role, however as she had a caution for child neglect, her caution was permanently disclosable on an enhanced and standard DBS check, and so she experienced significant difficulties in developing her career.

After instructing us, we investigated the client’s case and advised her that there was a basis for the deletion of her caution and we prepared detailed representations to the police for the expungement of her record.

The police initially refused to delete the caution, however after providing further detailed representations, and additional evidence, the police finally agreed to expunge the client’s caution.
