The National Police Chiefs&#8217; Council (NPCC) set out in their Deletion Guidelines ten general grounds for deletion. These grounds are:</p>

<li><strong>Unlawfully Taken</strong> – If DNA samples or fingerprints were obtained in violation of legal procedures.</li>
<li><strong>Mistaken Identity or Unlawful arrest</strong> – If the record was created due to incorrect identification, such as where someone has been cleared after participating in an ID parade.</li>
<li><strong>No Crime </strong>– If an individual was arrested but no offence occurred. This is not the same as proving your innocence, but is where no crime happened in the first place.</li>
<li><strong>Malicious or False Allegation</strong> – If credible evidence confirms that the allegation was fabricated, deletion may be granted.</li>
<li><strong>Proven Alibi</strong> – If an individual can provide corroborative evidence of an alibi which excludes them from the case.</li>
<li><strong>Incorrect Disposal </strong>– If a caution was issued in error, for example where there was no clear and reliable admission to the allegation, then it should be deleted.</li>
<li><strong>Suspect status not clear at the time of the arrest</strong> – if the police wrongly classified someone as a suspect, where they are in fact the victim or witness.</li>
<li><strong>Judicial Outcome</strong> – If a court orders record removal.</li>
<li><strong>Another person convicted of the offence</strong> – If there is no possibility of there being more than one offender, and someone else is convicted, then the record can be deleted.</li>

The process can take months and there is no guarantee that your request will be granted.</p>
<p>Typically the application will be sent to ACRO, who will forward the application to the relevant police force. ACRO themselves do not decide cases; they simply facilitate the process.</p>
<p>Some police forces will take 1 or 2 months to decide, but others will take much longer, sometimes up to 18 months.</p>
<p>If the initial decision is negative, you can appeal the decision within the same police force. The appeal decision may take 1 or 2 months, but it can take a further 12 months, and sometimes longer.</p>
<p>Dependant on the facts, an application can be prioritised, but pushing for a decision is not always appropriate. We will be able to advise you whether it is in your best interests to press the police for a quick decision.</p>

<p>All employers can ask for a Basic DBS check. It is in relation to a Basic DBS check that it matters whether your record is “spent” or “unspent” according to the <a href="https://www.gov.uk/government/publications/new-guidance-on-the-rehabilitation-of-offenders-act-1974" target="_blank" rel="noopener">Rehabilitation of Criminal Offenders Act 1974</a>.</p>
<p>All cautions are immediately &#8220;spent&#8221; for the purposes of a basic DBS check as soon as they are issued, no matter the type of offence, or when the caution was issued.</p>
<p>The only exception to this is in relation to a conditional caution. For a conditional caution it will become spent as soon as the conditions expire, up to a maximum of three months.</p>

<p>For youth cautions they will not be automatically disclosable on any level of DBS certificate, but may be revealed as &#8220;relevant information&#8221; on an enhanced DBS certificate.</p>
<p>For adult cautions, after six years, a caution will be &#8220;protected&#8221; and will not be revealed on a standard DBS check, but might continue to be revealed on an enhanced DBS check as &#8220;relevant information&#8221;.</p>
<p>In order for the police to reveal a protected caution, they would have to justify that it was necessary, reasonable, and proportionate to disclose the information. If you are arrested a second time, or receive a second caution, then it will make it much more likely that a protected caution will be revealed on an enhanced DBS certificate.</p>

A caution will be revealed directly on an <a href="https://policecautions.uk/2019/03/24/what-is-a-police-certificate/">ACRO Police Certificate</a> for either 5  or 10 years depending on the offence. Once the time period has elapsed, the caution will become “stepped down”. Once it is stepped down it will be indirectly revealed via a “no live trace” disclosure.</p>
<p>For anyone who has never been cautioned or convicted, their Police Certificate will simply state “no trace”. If you provide a “no live trace” certificate to a foreign embassy, most often they will then enquire into the details of your criminal record. Certain countries, notably the <a href="https://policecautions.uk/united-states-of-america-usa-immigration-and-criminal-records/">United States</a> and China, may block a Visa or citizenship application based on a police caution, depending on the offence, and when the caution was issued.</p>

Sometimes the police may simply warn someone they suspect of committing a crime, without giving then a formal caution.</p>
<p>A police caution is typically (although not always) issued at a police station. There are also formal procedures that you would need to go through. You should have been offered access to a lawyer, and been provided detailed warnings about the caution. Furthermore you should have clearly admitted to the allegation. So typically, you would know whether you have received a caution or not.</p>
<p>The police can sometimes issue cautions in other locations, outside of the police station, such as someone’s home, but this tended to happen more in the past. Even if a caution is issued outside of a police station, the same formal procedures should be followed by the police.</p>

<p>There are a number of grounds detailed by the National Police Chiefs’ Council (NPCC) for when a PNC record can be deleted. These include grounds such as where you can show the case was based on a mistaken identity, a malicious or false allegation, where no crime occurred, where the police incorrectly disposed of your case, and other grounds.</p>
<p>These deletion grounds are reflective of statutory and case law that has been promulgated over the years, so that all cases will generally fall into one of the NPCC’s grounds for record deletion.</p>

<p>The short answer is that it would cost nothing if you apply to the police for the <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/907499/Deletion_of_Records_from_National_Police_Systems__Guidance__v2.0.pdf" target="_blank" rel="noopener">deletion of your police caution yourself.</a></p>
<p>You can apply to the police to ask them to remove your caution from the <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">Police National Computer (PNC)</a>. If the police agree to the removal of your police caution, then that will be the end of the matter.</p>
<p>If the police do not agree to the deletion of your caution, then you have the option of doing nothing (in which case your police caution will remain on the PNC) or you can file for Judicial Review proceedings before the High Court.</p>
<p>You can lodge Judicial Review proceedings yourself, and this would cost you nothing other than the Courts fees and associated  costs (printing and/or expert witnesses). If however you did lose your case, the police can ask for the Court to order you to pay some, or all, of their costs.Therefore if you did take your case yourself, even though you would not have the cost (nor the benefit) of a lawyer, your police caution removal costs could still end up being fairly significant.</p>

<p>A caution not only prevents a suspect from having to go to court, but it also saves the government a significant amount of money.</p>
<p>Conditional cautions were originally introduced in 2003, but have been used in a very limited capacity. Often police forces would prefer to issue a simple police  caution (or other OOCD), which does not involved the monitoring of conditions.</p>
<p>There has however recently been a push to review the issuing of police cautions; generally due to the perception that simple cautions were being issued too often and suspects were effectively &#8220;getting away with it&#8221;.</p>
<p>Also there was a feeling that there were too many different types of out of court disposals.</p>
</div><div class="fusion-title title fusion-title-47 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Is a caution a slap on the wrists?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-53"><p>A caution is not in reality just a slap on the wrists, as they are retained on the PNC until a data subject reaches 100 years of age, they can be disclosed in subsequent criminal proceedings, during immigration checks, and on standard and enhanced DBS checks.</p>
<p>Despite these implications, in 2014 Chris Graying, who was  Justice Secretary at the time, announced <a href="https://www.gov.uk/government/news/putting-an-end-to-soft-option-cautions" target="_blank" rel="noopener noreferrer">a plan revamp the out of court disposal system</a> with a plan to end PNDs, cannabis warnings and simple cautions and to introduce a two-tier OOCD system. The lowest tier being community resolutions, and for more serious offending, a suspended prosecutions, aka conditional cautions.</p>
<p>Police in Staffordshire, West Yorkshire and Leicestershire trialed the new two-tier system, with the resultant <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/718947/adult-out-of-court-disposal-pilot-evaluation.pdf" target="_blank" rel="noopener noreferrer">report being published in 2018</a>.</p>
<p>With respect to costs, the two-tier pilot found that it cost 70% more to implement the new two-tier system. Essentially the increased cost was due to the additional monitoring that was required for community resolutions and conditional cautions.</p>
<p>There was also <a href="https://www.gov.uk/government/publications/out-of-court-disposals-pilot-cautions-reoffending-analysis" target="_blank" rel="noopener noreferrer">no evidence that showed the two-tier systems helped to reduce re-offending</a>; re-offending within the following three months of an OOCD being issued was at 5% in both the two-tier trial and under the current system.</p>
</div><div class="fusion-title title fusion-title-48 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">NPCC Two-Tier Out of Court Disposals (OOCD)</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-54"><p>Despite the findings the NPCC have introduced a new <a href="https://www.npcc.police.uk/Publication/Charging%20and%20Out%20of%20Court%20Disposals%20A%20National%20Strategy.pdf" target="_blank" rel="noopener noreferrer">two-tier national strategy</a>. The National Strategy has not been put into a formal legislative footing due to Brexit, namely there has been no parliamentary time, but the policy is implemented as policing strategy.</p>
<p>As there is currently no legislative support for the strategy, and so no additional funding to sustain the new system, the NPCC have stated that police forces will implement the two-tier strategy <em>&#8220;when it is operationally and financially viable within each force area.&#8221;</em></p>
<p>What this means is that simple cautions, PND and cannabis warnings may continue to be issued, particularly where a police force has limited resources and an inability to devote the extra resources to supervising conditional cautions/community resolutions.</p>
<p>For hard pressed police forces, of which there are many, conditional cautions have not historically been used given they are an extra drain on precious police resources. Without extra funding being put in place it is difficult to see all police&#8217;s forces rushing to adopt the new two-tier framework.  If they do, it is possible officers will only impose conditions that require the least amount of supervision i.e. a letter of apology and/or a fine.</p>
</div><div class="fusion-title title fusion-title-49 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">When can a conditional caution be issued?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-55"><p>A conditional caution can be issued for minor offences by the police, but for more serious offences they must get permission from the CPS.</p>
<p>In hate crime cases, or for domestic violence cases, a conditional caution will not generally be considered but they can be offered if approved by the CPS.</p>
<p>Conditional cautions can also be issued for &#8220;relevant foreign offenders&#8221; with the aim of securing the departure of the offender from the UK rather than incurring the cost of prosecuting that person.</p>
<p>Conditions imposed must be proportion, appropriate and achievable &#8211; in our experience the conditions our clients have been imposed have always been limited to the writing of an apology letter, and the paying of a fine.</p>
<p>Conditions are usually expected to be completed within 16 weeks, and no longer than 20 weeks (although may be longer in relation to foreign offenders) &#8211; most cases we have seen have a requirement to comply within 8 &#8211;  12 weeks.</p>
</div><div class="fusion-title title fusion-title-50 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">I don&#8217;t agree with my conditional caution, should I comply with its terms?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-56"><p>Although each case will be unique, and you will need to take specific advice on your case if you wish to challenge your conditional caution, we would as a general rule advise anyone to comply with the terms of their conditional caution once it has been issued.</p>
<p>If you do not comply with the terms of your conditional caution you run a very real risk of being prosecuted at court, which would obviously be worse than your caution. A prosecution at court may result in conviction, and a possible prison sentence.</p>
</div><div class="fusion-title title fusion-title-51 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Can I Challenge a Conditional Caution?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-57"><p>It is possible to challenge a conditional caution, this can be done by direct appeal to the police, via the NPCC&#8217;s early deletion process, via High Court judicial review proceedings, possibly the ICO, or a combination of these processes.</p>
<p>It will very much depend on the facts of your case, but critically if you believe you are innocent, and you feel you were railroaded into accepting a conditional caution, then you may have a case to have your  conditional caution deleted.</p>
</div><div class="fusion-title title fusion-title-52 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">How long does a conditional caution last?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-58"><p>A conditional caution on a <a href="https://policecautions.uk/2019/11/03/can-you-appeal-a-dbs-check/#spent">basic DBS check </a>will become spent after 3 months if the conditions last 3 months or more, or on the date the conditions end if the conditions last less than 3 months.</p>
<p>With respect to a <a href="https://policecautions.uk/standard-disclosure-and-barring-service-dbs-certificates/">standard</a> and <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">enhanced DBS checks</a>, a conditional caution will be automatically disclosed for 6 years, after which it will become &#8220;protected&#8221; (data protected) and will no longer be disclosed. The conditional caution will however continue to be disclosed if the offence is on list of more serious offences, in which case it will be permanently disclosed.</p>
<p>Examples of offences that appear on the list of more serious offences are ABH, affray and child cruelty/neglect.</p>
<p>Also a conditional caution can continue to be disclosed as &#8220;relevant information&#8221; on an <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">enhanced DBS</a> check after 6 years even if the offence is not on the serious offences list.</p>
</div><div class="fusion-title title fusion-title-53 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">What is a youth conditional caution?</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-59"><p>Youth conditional cautions are in essence the same as adult conditional cautions in that they are  also suspended prosecutions. Two differences are however that a youth  offender is supervised by the Youth Offending Team (YOT) and foreign offender conditions are not available for youths.</p>
<p>Youth cautions, warnings and reprimands are immediately  &#8220;protected&#8221; subsequent to changes implemented by the government in November 2020. This means that even for offences that appear on the DBS list of unfilterable offences, they will not be automatically be disclosed on an enhanced and standard DBS check. It should be noted however despite the changes, it is still possible for facts related to youth cautions, warnings or reprimands to still be disclosed on an enhanced DBS certificate if the police feel the information is &#8220;relevant&#8221;.</p>

After having this record removed, we then applied to completely clear up the client’s records, to have his details removed from the police’s local systems and the Police National Database (PND).</p>
</div><div class="fusion-title title fusion-title-55 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Locally Held Records and DBS Certificates</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-62"><p>Locally held records, even where no caution or conviction resulted, can cause issues on <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">Enhanced Disclosure and Barring Service (DBS)</a> checks. The client worked in a regulated sector and so was concerned that the local records might appear on their enhanced DBS certificate check as “relevant information”.</p>
</div><div class="fusion-title title fusion-title-56 fusion-title-text fusion-title-size-two"><h2 class="fusion-title-heading title-heading-left" style="margin:0;">Removal of Locally held Police Records and Enhanced DBS Certificates</h2><span class="awb-title-spacer"></span><div class="title-sep-container"><div class="title-sep sep-double sep-solid" style="border-color:#e0dede;"></div></div></div><div class="fusion-text fusion-text-63"><p>We set out our representations to the police detailing our reasons for removal based on the principles of management of police information (MoPI) and legal precedent.</p>
<p>The police agreed that the records no longer required retention and conformed all remaining trace of the client’s details had been removed from their systems. The client subsequently applied for an <a href="https://policecautions.uk/2019/02/06/what-shows-up-on-an-enhanced-dbs-check/">enhanced DBS certificate</a> and it came back clear.</p>
