The Government has effectively adopted a “what if” or “no smoke without fire” approach to <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC records</a> – namely although an arrest record might not say you are guilty, the police want to keep these records “just in case”, namely just in case you were guilty, and you are accused of anything else in the future. Many countries around the world do not follow the UK’s approach, and have strict rules about when records should be deleted, including convictions. While some countries, it might be said, delete too much data, the UK is one of, if not the most, strict nation when it comes to the retention of criminal records data.</p>

We went through all the evidence step by step, texts messages and voice messages, photos, CCTV, and other digital evidence that clearly showed that the complainant had fabricated the allegations. As with our client mentioned above, the client had also developed anxiety and depression in the aftermath of his arrest, and it took him months to recover from the impact of the false allegation. The removal of the arrest record helped him move on from the incident.</p>

The police promptly agreed to delete the arrest record from the PNC,  and they also removed him from their local police systems.</p>

<p>On the face of it the client had accepted the caution and the police had undertaken their investigation correctly. On closer examination however, we were able to uncover defects with the investigation, and the police caution procedure, which rendered the caution unlawful.</p>
<p>After making representations to the police, they agreed to expunge the client’s caution and biometric data.</p>

<p>The police will routinely issue police cautions for <a href="https://www.policecautions.uk/crb-domestic-disputes-caution/">minor domestic incidents</a>, and for the police, a caution is often seen as a light touch response to an incident. The reality can however be far worse than a simple “slap on the wrists” as cautions can, and do, have long term consequences.</p>
<p>All police cautions will be disclosable on a standard or enhanced <a href="https://www.policecautions.uk/enhanced-disclosure-and-barring-service-certificate-dbs/">Disclosure and Barring Service (DBS)</a> certificate for at least 6 years; for more serious offences, a caution will be disclosed forever.</p>

<p>The law gives broad powers to the police and DBS to disclose information on an enhanced DBS certificate where there are concerns raised related to children and vulnerable adults – this is especially so where the allegation involved serious violence or sexual abuse.</p>
<p>Along with having police cautions expunged, we have successfully applied in the past to have <a href="https://www.policecautions.uk/deleting-of-arrest-records-from-the-police-national-computer-pnc/">arrest records</a>, biometric data, custody photos and local police records deleted.</p>
