<h2>What is Actually Kept?</h2>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>The law requires all DNA samples to be destroyed within 6 months of being taken (unless the sample is needed for court proceedings). This allows time for a DNA profile to be produced to be added to the National DNA Database (NDNAD).</p>
<p><!-- /wp:paragraph --><!-- wp:paragraph --></p>
<p>DNA profiles are stored on the NDNAD and consist of a string of 10 pairs of numbers (though this will be increasing to 17 in the near future) and 2 letters (XX for women, XY for men) to indicate gender.</p>
<p><!-- /wp:paragraph --><!-- wp:paragraph --></p>
<p>Fingerprints are usually scanned electronically from the individual in custody and the images stored on IDENT1, the national fingerprint database.</p>
<p><!-- /wp:paragraph --><!-- wp:heading --></p>
<h2>When can the Police Retain my DNA and Fingerprints?</h2>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>The police can indefinitely retain your DNA and fingerprints if, as an adult, you were convicted (including cautions) for any recordable offence.</p>
<p><!-- /wp:paragraph --><!-- wp:paragraph --></p>
<p>The police can also retain your DNA and fingerprints indefinitely if you were convicted (including youth cautions/reprimands/final warnings) for a &#8220;Qualifying Offence&#8221;.</p>
<p><!-- /wp:paragraph --><!-- wp:paragraph --></p>
<p>A Qualifying Offence is a more serious offence such as murder, manslaughter, <a href="https://policecautions.uk/2025/03/26/deletion-of-arrest-records-for-rape-allegations/">rape</a>, wounding, assault occasioning grievous bodily harm, assault occasioning actual bodily harm, robbery and burglary. Also included are numerous sex, indecency and firearms offences. There are currently are over 400 qualifying offences.</p>

<p>Also if you are a youth and have been convicted of a &#8220;Minor Offence&#8221; then on your first conviction your DNA and fingerprints can be retained for five years plus the length of any prison sentence, or indefinitely if the prison sentence is more than five years. On a second conviction retention is indefinite. A Minor Offence is any recordable offence that is not a qualifying offence.</p>

<h2>What if I was never Charged or Convicted?</h2>
<p><!-- /wp:heading --><!-- wp:heading {"level":3} --></p>
<h3>Charged but not convicted</h3>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>If you were charged but not convicted of an offence, at any age, then your DNA and fingerprints can be retained for three years, plus a two year extension if granted by a District Judge, or indefinitely if you have previously been convicted of a recordable offence which is not &#8220;excluded&#8221;. An excluded offence is any recordable offence:</p>
<p><!-- /wp:paragraph --><!-- wp:list --></p>
<ul>
<li>That is not a qualifying offence.</li>
<li>That was committed when the person was under 18 years old.</li>
<li>For which the person was not given a custodial sentence of more than 5 years</li>
<li>That is the only recordable offence of which the person has been convicted.</li>
</ul>

<h3>Arrested but not charged</h3>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>If you were arrested for, but not charged with a qualifying offence, at any age, then your DNA and fingerprints can be retained for three years only if the Biometrics Commissioner permits it, and then a further two years if an extension is granted by a District Judge, or indefinitely if you have previously been convicted of a recordable offence which is not &#8220;excluded&#8221;.</p>

<h3>Arrested for or charged with a Minor Offence</h3>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>If you have been arrested or charged, but not convicted, of a minor offence the police may not retain your DNA unless you have had previous conviction for a recordable offence which is not excluded.</p>
<p><!-- /wp:paragraph --><!-- wp:paragraph --></p>
<p>Prior to deletion of DNA and fingerprints the police will conduct a speculative search against an individual&#8217;s DNA and fingerprint records to see if they are linked to any active investigation.</p>
<p><!-- /wp:paragraph --><!-- wp:heading {"level":3} --></p>
<h3>Penalty Notices for Disorder</h3>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>If you have been given a Penalty Notice for Disorder (PND) then your DNA and fingerprint records will be held for two years.</p>
<p><!-- /wp:paragraph --><!-- wp:heading --></p>
<h2>Early Deletion of DNA and Fingerprints</h2>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>It is possible to apply for the &#8220;Early Deletion&#8221; of your DNA and fingerprints before the end of your retention period. Early deletion is possible if you can provide evidence for grounds for deletion and:</p>
<p><!-- /wp:paragraph --><!-- wp:list --></p>
<ul>
<li>You have no previous convictions and your biometric information is held due to a Penalty Notice for Disorder (PND); or, </li>
<li>You have no previous convictions and your biometric information is held as a result of you being arrested and charged with a Qualifying Offence but you were not subsequently convicted.</li>
</ul>

<h2>Early Deletion of PNC Records and or DNA/Fingerprints</h2>
<p><!-- /wp:heading --><!-- wp:paragraph --></p>
<p>If would like your fingerprints and DNA records deleted from police systems, or if you have <a href="https://policecautions.uk/2019/01/26/what-is-the-police-national-computer-pnc/">PNC</a> or local <a href="https://policecautions.uk/2019/01/28/what-is-the-police-national-database-pnd/">PND</a> records that you would like to be expunged, then we are able to help.</p>

<p>Please note we are not able to apply to have convictions deleted from the PNC. Court convictions need to be challenged via appeal to the Crown Court or Court of Appeal, you may also be able to appeal to the <a href="https://ccrc.gov.uk/" target="_blank" rel="noreferrer noopener" aria-label="Criminal Cases Review Commission (opens in a new tab)">Criminal Cases Review Commission</a> (CCRC).</p>

<p>The police were called and wrongly arrested the client. The client was taken into custody and placed in a police cell.</p>
<p>After taking fingerprints and a DNA sample, the client was interviewed. After the interview a caution was offered which was agreed to by the client, who was anxious to return to her young children.</p>
<p>Little information was provided by the police with respect to the implications of the caution, and the client was rushed into making a very quick decision. It was only after the client was released from custody did she become aware of the significant implications of the caution.</p>

<p>After a relatively short period of time, the police not only agreed to expunge the client’s police caution, they also agreed to delete the client’s arrest record (please see here: <a href="https://www.policecautions.uk/deleting-of-arrest-records-from-the-police-national-computer-pnc/">for more information on deletion of arrest records</a>).</p>
<p>The client is now able to resume her career in education without worrying about disclosure of any unfavourable information on a Disclosure and Barring Service (DBS) Certificate.</p>

<p>The client, after spending the night in a police cell, worrying about work the next day, readily accepted the police’s version of events and accepted a police caution.</p>
<p>The police told the client the caution was of limited consequence and if he didn’t agree to it he would be prosecuted.</p>
<p>After leaving police custody, the client investigated the true implications of the caution, and the correct procedures the police ought to have adopted at the police station. The client then contacted us.</p>
<p>After accessed his case, we were able to identify errors in the caution procedure adopted by the police and the client’s arrest.</p>
<p>We promptly made representations to the police who ultimately agreed to not only delete the client’s police caution, but also agreed to expunge the clients arrest record, DNA, finger prints and custody photograph.</p>

<h2>Arrest Record Deletion</h2>
<p>When a suspect is arrested, the police will create a <a href="https://policecautions.uk/deleting-of-arrest-records-from-the-police-national-computer-pnc/">Police National Computer (PNC) arrest record</a>.</p>
<p>An arrest record will be retained indefinitely (until the person is 100 years old) unless the police agree to delete it. An arrest record will therefore be created even if a suspect is never cautioned nor convicted.</p>
<p>An <a href="https://policecautions.uk/deleting-of-arrest-records-from-the-police-national-computer-pnc/">arrest record</a> can cause an individual difficulties as it can be disclosed on enhanced Disclosure and Barring Service (DBS) certificates.</p>
<h2>Police Caution and Arrest Record Deletion</h2>
<p>We have extensive experience of challenging the retention of police records, including DNA, fingerprints, police cautions, arrest records, PND’s and other non-conviction records (such as local CRIS reports).</p>

<h2>Disclosure and Barring Service Appeals</h2>
<p>Along with successfully applying for the expungement of police records, we also are often instructed to challenging DBS certificates and DBS applications to bar.</p>
<p>If you have received a DSB certificate with information you dispute, then we are able to assist you appealing your certificate.</p>
<p>If you have already been placed on the barred list, we can apply to have you removed. If the DBS have written to you expressing their intention to place you on either the children or adults barred list, or both, then we are able to assist – we have helped many clients resist being placed on the barred lists.</p>
<p>If you have received a police caution, especially if it is for a more serious offence, and particularly if it is of a sexual nature, the DSB at some stage are likely to instigate the barring procedure against you. Given our experience in this field, we are well positioned to challenge both the retention of your police caution and any DBS barring application.</p>
