Child Assault Police Caution Deleted

Our client had been issued a police caution with respect to an allegation of assault on her child. Her child’s school had picked up the allegation and reported it to the police.

The client was asked to attend the police station as a volunteer, and attended with legal representation. The solicitor advised the client to accept a police caution in order to avoid prosecution.

As the client works in a regulated sector, a caution for assault on a child would of had devastating consequences on her career and it remained in place.

After we were instructed we investigated the police’s case and were able to determine that the caution may have been unfairly issued.

After drafting representations, the police agreed to overturn the caution and expunged the client’s PNC record. Not only was the caution deleted, but also the client’s fingerprints, DNA, and custody image.
