Criminal Damage Police Caution Expunged

Our client was issued a caution for criminal damage in his own home, related to a domestic incident.

The client had accepted the services of the duty solicitor, and accepted a police caution. It was only after leaving the police station with the caution, and searching online, that the client realised that the caution would have a permanent detrimental impact on his life.

The client was a foreign national, working for a multinational corporation. The caution jeopardised his ability to remain in the UK, and therefore also his profession, as well as his family’s financial security.

As the caution was having such a serious adverse impact, the client had to have his caution expunged, or face leaving the UK and losing his job.

After we analysed the evidence, we realised that there were some major flaws with the way in which the case had been handled by the police. We carefully prepared the client’s case, and promptly managed to persuade the police that the caution was unlawful, and that it out to be expunged from the Police National Computer (PNC).

After a relatively brief period of time, the police agreed with our representations, and expunged the client’s caution form the PNC.

As the caution was expunged, the incident had no impact on the client’s visa, and employment, and he has been able to continue with his life as before.
